As we discussed in our last year-end alert, in December 2010, the SEC entered into an NPA with Carter’s Inc.[5] In May of this year, the SEC announced its first DPA, Tenaris S.A., to resolve alleged violations of the Foreign Corrupt Practices Act (“FCPA”).[6] Pursuant to the DPA, Tenaris agreed to pay $5.4 million in disgorgement and interest relating to claims that it improperly procured Uzbekistani oil and gas contracts.
