Doubt was cast upon this practice in early 2021 in a CMC in Sandoz v BMS[7][2021] EWHC 393 (Pat) (Ch) and Teva v BMS where Mellor J observed that the practice of listing the trial before the CMC might well be doing things the wrong way round , and lead to parties jumping the queue to get their trial listed whilst others completed their pre-CMC formalities.
