As a point of interest, it should be noted that it is immaterial whether clause 2(a) is an exclusive or non-exclusive jurisdiction clause after the Court of Appeal’s decision in Shanghai Turbo v Liu Ming [2019] 1 SLR 779 (previously noted here); as Singapore is a named forum, the “strong cause” test would apply to cases falling within the scope of the jurisdiction clause.
