On appeal, Starbucks (HK) argued that Arnold J was wrong to find that its mark was invalid and that it had not generated any protectable goodwill in the UK on the basis that, although its goodwill originated from subscribers in Hong Kong, it had spread geographically to Chinese-speaking residents in England.The Court of Appeal, for whom Sir John Mummery delivered the judgment was not impressed and dismissed the appeal.
