In a recent case where the putative class alleged that Sue Bee honey was falsely labeled as being “pure” and “100% pure” where the products contained trace amounts of glyphosate, the court granted summary judgment concluding that the consumer survey relied upon by plaintiff “avoided the relevant question” of whether a reasonable consumer would interpret the term “pure” to exclude trace amounts of glyphosate.
