The last five administrations, dating back to President Bill Clinton, have ordered the withdrawal of all unpublished rules from the Federal Register and have treated them as if they had never been promulgated, even though the Secretary of the relevant Department would have already signed the rules and possibly posted them on the agency’s website before sending them to the Federal Register for publication.
