The district court granted summary judgment to State Farm, finding that the applicant had provided “prior express consent” on Osorio’s behalf because the applicant had “common authority” over the telephone number (they shared the wireless plan) and the FCC has previously held that the provision of a wireless telephone number can amount to “prior express consent.
