It is clear from the reasons of G 4/93 and G 9/92 that when arriving at its answer, the Enlarged Board (EBA) considered the purely procedural aspects of the appeal proceedings, without considering the - undoubtedly undesirable - consequences of the maintenance of “invalid” patents. [read post]
