  Imagine that the jury had collectively gone to the scene and reenacted the murder and concluded, yep, given the topography of the area, it'd have taken two people to drag someone up the hill and kill them, despite the fact that there was no evidence at trial at all about whether the area had hills, and convicted the defendant accordingly.
