Based upon a quickie review of Oklahoma law, we don't think that, as a matter of that state's legislative intent element for negligence per se, it would recognize the cause of action being alleged in Howard.As for issue #2, there are also states that reject negligence per se where its effect is to impose a "novel" duty beyond ordinary tort principles.
