Annex I include a definition of foreign subsidy which largely mimics WTO language but also include interesting additions coming from EU state aid law: ‘Foreign subsidies’ would cover both the goods and services sector and would fall under a future new EU legislation only insofar as they ‘directly or indirectly cause distortions within the internal market’ – reads the Annex.
