NCCI Announces 6.8% Rate Reduction Request
The National Council on Compensation Insurance has recommended a 6.8% reduction in the average premium charged to Florida employers for workers' compensation insurance. The reduction would become effective on January 1, 2010. If approved by the Florida Office of Insurance Regulation, the reduction would bring to 63.2% the total average premium reduction enjoyed by Florida employers since the 2003 reforms were enacted. Fifth District Finds Error in Failure to Set Religious Timesharing Schedule
The Fifth District Court last week issued a substituted opinion in Arcot v. Balaraman. Of particular interest was the fact that both parties were practicing Hindis, and the lower tribunal was specifically found to have erred in failing to set a schedule for the children to observe the religious holidays respected by that religion. Yesterday the Fourth District Court of Appeal upheld the trial court's denial of a challenge for cause directed at a potential juror in a case involving murder-for-hire. In Samuels v. What is the difference between an adjudication of guilt and a withhold?
If you are arrested in Jacksonville or anywhere in Florida and enter a plea to the crime, the judge can either withhold adjudication or adjudicate you guilty. A study that was recently released showed that half of teens that own cellular phones admit to texting and talking while driving. The study surveyed 800 teenagers that were all 17 years of age. Dade County School Bus Drivers Told No Text Messaging While Driving
Dade County school bus drivers may be banned from texting on their iPhones and Blackberrys while on the roads except in emergency situations. If the proposal passes it would apply to all county employees driving district owned vehicles. A driver has been arrested for a Polk County DUI after he allegedly causing a traffic crash while texting. The defendant, 26-year old Stephen Wade Horne, is accused of texting on his cell phone when he crashed into a stopped garbage truck. A trash collector employee, 20-year old Emmanuel Mejia, fell victim to the accident and was pinned between the vehicles. Mejia ended up losing both of his legs from injury. Last week more than 4,000 Polk County residents lost power for over 16 hours after a suspected drunk driver collided with a main electrical transmission pole.
