Dalia Albert, 26, was seriously injured in an Orange County truck accident after her bicycle crashed into a semi-trailer the afternoon of November 19, 2009. According to a news report in The Orange County Register, the big rig, driven by 29-year-old Juan Soto, was in the right lane of eastbound Edinger Avenue in Huntington Beach. He was apparently waiting at the light to turn right on Gothard Street. Albert was riding her bike east in the bike lane when the light turned green. Albert kept... Do You Need A California Car Accident Lawyer

A California Personal injury claim can vary in complexity. Some require experienced attorneys, while others can be settled without one. People who are involved in a car accident can handle their own claims. It is similar to handling your own injury. If you injury is a scratch to the leg you can put some antiseptic on it and a Band-Aid. If you have a broken leg that needs to be set, I don't think you want to handle it yourself. This is the same with auto accidents. The more serious the accident,... Posted on November 20, 2009 at 12:01 am

Ten percent of these Pennsylvania car accidents were caused by some degree of driver distraction. Statistics show that distractions while driving are the major contributors to highway car accidents involving teenagers and young adults. The overwhelming majority of PA drivers buckle up…

An October 2009 report from the Pennsylvania Department of Transportation (PennDOT) shows that Pennsylvania drivers overwhelmingly make the choice to buckle-up. PennDOT found that 87.9 percent of motorists engage their seatbelts when driving, an increase from 86.7 percent of motorists in 2007. It is believed that safety enforcement on the part of municipal police departments and the Pennsylvania State Police is in large part responsible for the rise in seat belt usage. Prematurity Awareness Month

November is Premature Awareness month. Being born early puts children at risk for developing many conditions including cerebral palsy. When a child is born prematurely often their lungs may not be fully developed. This lack of pulmonary maturity can be very dangerous for the child. Often, a delivery may have been prevented / delayed or medications should have been administered to help the child develop more rapidly. Failing to adhere to these standards of care may constitute medical... Posted on November 21, 2009 at 03:10 pm by Robert A. D'Iorio

I have written in the past of David Sexton's articles in the New York Times pertaining to his son's cerebral palsy. This week David writes about going to a family wedding and discussing his child's condition for the first time with family and friends. Legal Malpractice--How Your Laywer Can Stick it To You Again....

One major issue that arises in many legal malpractice cases is whether the client can recover damages from the lawyer in a legal malpractice case if the damages were not collectible (or questionable) in the underlying case. Here is an example: Mr. Drunk Driver crashes into Mr. Innocent. Mr. Drunk Driver doesn't have any insurance to pay for Mr. Innocent's injuries, nor does Mr. Drunk Driver have money or assets. Mr. Innocent finds a TV advertising lawyer that promises to get him a quick... Posted on November 6, 2009 at 05:00 am

Trucker Hits Stray Cow on Highway and Dies. Is anyone at fault?

Who's to blame when a stray cow comes in the path of a moving vehicle? I'm sure that's just what the family of the driver of a semi trailer is asking today. At about 2:15 a.m. on Tuesday October 20th 2009 a still unidentified man hit a cow in the middle of Iowa Highway 14 between Chariton and Millerton. After the truck hit the cow it went into a ditch and then into a creek. Apparently the truck driver died. In rural Iowa this isn't such a rare occurrence. With cases like this one, lawyer-talk... I wonder if I could die from defensive medicine not being practiced in Iowa. Over the weekend Barbara drove me to the local clinic because I was sick as a dog and coughing so hard my lungs and chest and upper back muscles ached. Dodgeball Lawsuit

Deadspin has post about a boy who has filed a lawsuit over injuries suffered while on the bleachers of a dodgeball middle school. Apparently, the boy was in a car accident and had dental work done. The ball broke his new bridgework. First, I think Deadspin completely screws up by naming the boy. I cannot imagine what the point would be. The one thing that has some appeal from a plaintiffs' lawyers point of few: they were using soccer balls for the dodgeball game. That is just an awful idea. Tennessee Woman Gets Twelve Years for Sleeping with a 17 Year-Old Boy

Another Above the Law link. A former Portland High School teacher convicted of having sex with her underage teacher's aide has been sentenced to 12 years in prison. The title of the post is a little misleading. She is eligible for parole in four years. She was a teacher who slept with the student who was in high school. Maybe she should go to jail for that, she is in loco parentis and all of that. But the kid was a month from turning 18. Twelve years seems insane? Posted on November 16, 2009 at 10:44 am by Ronald V. High-End Manufacturer Recalls Umbrella Strollers for Finger Amputation Risk

Regulators Failed to Consider Many Cases of Unintended Acceleration in Toyotas

A few weeks ago, I wrote a post about a Los Angeles Times report on the recall of 3.8 million Toyota and Lexus vehicles. Officially, the recall is because of defective floor mats that can cause accelerators to get stuck open, causing unintentional acceleration that can propel the vehicle uncontrollably and cause serious accidents. A total of 19 deaths have been reported because of this safety flaw. In the older post, I wrote that the Times suggested advanced features in newer vehicles -- or... Report Shows Automatic License Suspension for Accused Drunk Drivers Isn’t Automatic

On Nov. 1, the newspaper published a third installment in the series, on the revocation of driver's licenses for drivers who refuse to take a breath test. Outsourcing Marketing = Outsourcing Ethics (5 Problems With Outsourcing Attorney Marketing)

Five months back there was a Metro train crash in Washington DC, and I watched from a distance to see who/how/where/when the web would be used by lawyers to find victims. And one of the things we saw was that one of the gazillion attorney search firms that infect the web was soliciting clients. Given that these search firms are agents of the lawyers, that raised the problem of attorneys using the web to solicit. Thus was born this little formula in June: outsourcing marketing = outsourcing... Posted on November 15, 2009 at 10:00 pm by Eric Turkewitz

Seat Belt Syndrome: Child Safety Continues to Take a Back Seat

More needs to be done to prove child safety when it comes to seat belts-especially as not all US states require that kids ages 4-8 use booster seats. Unfortunately most seat belts are unable to properly fit over the bodies of many children to ensure maximum protection, which can result in catastrophic seat belt-related injuries, known as seat belt syndrome, during a car accident. Larsen ruled that limiting payments for "non-economic damages" such as pain and suffering is unconstitutional. The law caps those awards in malpractice suits at $500,000 per case for doctors and $1 million per case for hospitals. There is no cap on economic damages, such as loss of pay. The experimental compound, 4-aminopyridine-3-methyl hydroxide, has been shown to restore function to damaged axons, slender fibers that extend from nerve cells and transmit electrical impulses in the spinal cord.... Volvo recently announced that it was recalling over 9,000 of its 2010 XC60s, because of potential seat belt defects. Last month, the Insurance Institute of Highway Safety conducted a side-impact test to determine which cars would be included in its "Top Safety Pick" awards. Unexpectedly, during the crash test, the driver's seat belt in the Volvo XC60 came undone. A Volvo spokesman reported the seat belt problem had not occurred during their safety tests. However, it was determined that the seat... Posted on November 19, 2009 at 02:18 pm

Chicago Psychiatrist has Troubling Record with Clozapine

The Chicago Tribune recently reported that Dr. Michael Reinstein, a doctor who frequently gives psychiatric care in Chicago-area nursing homes and mental health facilities, has developed a troubling record. This record involves providing care with an extremely risky drug: Clozapine. Clozapine is a very powerful drug that carries five FDA black box warnings, the strongest warnings the FDA can issue. According to the Tribune, Mr. Reinstein, exhibits an "unusually heavy reliance" on this powerful... Posted on November 18, 2009 at 01:47 pm

Accutane and Increased Risk of Inflammatory Bowel Disease

/**/ In June of this year, Roche Holding quietly pulled the drug Accutane from the market. Accutane is prescribed to treat moderate to severe cases of acne. The drug has had an extensive history of leading to adverse effects since its approval in 1982, such as suicidal behavior and birth defects. The removal of the drug from the market came in the face of increasing proof that Accutane leads to another serious health problem: Inflammatory Bowel Disease. Last week, a study quantified the... National Football League Questioned: Do Helmets Help, or Hurt?

I read an interesting story in the Wall Street Journal today, which raises the question as to whether or not helmets should be banned in the National Football League (NFL). In recent months the NFL has come under scrutiny after research revealed the long-term dangers associated with concussions and other head injuries sustained by players during a game. Though everyone knows football has always been a dangerous sport, recent research proves that although a player may seem fine after an injury,... Posted on November 11, 2009 at 08:44 am

Illinois Drunk Driving Lawsuit - Case settled for Insurance Policy Limits of $100,000 - Low Offer Prior to Lawsuit

Back in early 2008 we were retained as the injury lawyers by the victim of a Belleville Illinois drunk driving crash at a major intersection. Initially, the victim retained a different personal injury law firm who secured a settlement offer of just under $50,000, however, the victim did not want to accept and the previous attorneys did not believe the case was worth more than that offer. Accident lawyers attempting to negotiate settlements with insurance companies tend to view insurance companies as monolithic, i.e., "Insurance Company A is difficult' or "Insurance Company B is easy to deal with on claims." Micra Limits Everything

I recently spotted an article on the topic of MICRA (Medical Insurance Compensation Reform Act) and the need for reform. The article spoke at length about how MICRA limits pain and suffering damages to $250,000, and the need for reforms on that over 30 year old limitation. The problem I had with the article is that it vastly understated the true extent of the limitations imposed by MICRA, and the devastating consequences those limits have on injured people. The $250,000 limit is just one of... Posted on August 18, 2009 at 11:29 am by Steven Schultz

I'm not going to try and describe what nanotubes are, aside from saying that they are very thin (1/50,000th the width of a human hair) man made [usually] carbon based tubes (fullerene "buckyballs" is another phrase that describes them, if that helps.) If you'd like to know a whole lot more about them, the Wikipedia article might be a good start. Nanotubes are on this blog because researchers have apparently discovered that nanotubes cause mesothelioma in mice. I hasten to add that fiberglass... California Adopts Sophisticated User Defense

In Johnson v. American Standard ( California Supreme Court Case No. S139184 (4/3/08)) the California Supreme Court found the perfect case in which to finally adopt the "sophisticated user defense", something that the U.S. District Court predicted would occur in 1982. The "sophisticated user defense" exempts a manufacturer of a product from providing warnings about that product to sophisticated users reasonably should have known of the potential hazards. American Standard was sued in this case... Posted on April 3, 2008 at 02:40 pm by Barbara Adams

Kids with obesity-linked gene like fattening foods

Scientists may have figured out one reason some people reach for the french fries instead of an apple. It could be a gene that's been linked to an increased risk of obesity. A study of children found those with a common variation of the gene tend to overeat high-calorie foods. They ate 100 extra calories per meal, which over the long term can put on weight, said Colin Palmer, who led the study at the University of Dundee in Scotland. Posted on December 11, 2008 at 07:05 pm

As a construction accident attorney, Kirk Bernard is aware that when working on a construction site in the state of Washington, there are steps you can take to protect yourself from a construction site injury. Being aware of your surroundings and potential danger is the first step to avoid suffering an injury in a Seattle construction accident. Make sure you wear appropriate personal protective equipment. Don't, for example, show up at a construction site wearing thin-soled shoes. Nails could... Posted on November 20, 2009 at 03:28 pm by Washington Personal Injury Attorney

Kirk Bernard Discusses Aftermath of Construction Wrongful Death Accidents in Washington

The death of a loved one can have a devastating impact on surviving family members. During this time of grief, it's difficult to think of anything else except the loss of that special person. But after the grieving ends, what is there to do about the ones who caused the death? Did the construction site employers, contractors and/or subcontractors fail to provide a safe environment for the loved one? Did that failure cause the accident that led to the death of the loved one? Wrongful death can... Posted on November 20, 2009 at 10:17 am by Washington Personal Injury Attorney

There is potential for an accelerator pedal to get stuck in the full open position because of an incompatible or unsecured driver's floor mat. A jury in Georgia awarded the family of a deceased woman $6M on October 20 in a medical malpractice action. The woman had had knee surgery, and afterward developed deep vein thrombosis (DVT), essentially a blood clot in the leg, which travelled into her lungs, causing a pulmonary embolus (PE) and her death. DVT and PE are preventable complications. There are several drugs that protect against clotting, as well as mechanical safety measures (compression legwear, foot pumps). The deceased was at... Republican Health Care Bill Takes "Tort Reform" to Extremes

Republican members of congress put forward their own healthcare reform bill last month to counter the healthcare bill authored by Democrats, which currently has majority support. Among other things, the bill seeks to cap non-economic damages for injured victims of medical malpractice at $250,000. Preisent Obama has made clear that he wants to work with groups such as the American Medical Association to achieve reform, but he is not interested in implementing limitations on the rights of injured... Habush v. Cannon - part V

A quick note too, the recent Journal-Sentinel article is wrong in asserting that the "Sponsored link [is] gone." I again just searched Yahoo! and Google as well as Bing and all three have sponsored links when you search for "Habush" or "Rottier" that lead to the website of Cannon & Dunphy. Habush v. Cannon - part IV

JS Online now as an article about the war of words and a quote from Cannon saying of the lawsuit and Habush, "It's ridiculous. He looks like a buffoon." Personally, I don't think either is true here. Let's take a look at the legal basis for the Habush v. Cannon lawsuit: Wisconsin's Right to Privacy law, Wis. Stats. &#xc2&#xa7995.50, states: (1) The right of privacy is recognized in this state. *** (2) In this section, "invasion of privacy" means any of the following: *** (b) The use, for advertising... Habush v. Cannon - part III

AP has a story on this now in which the two reputable Wisconsin pesonal injury attorneys are now having what can only be described as an ugly war of words. Per the story, among other things, Attorney Bob Habush said: "If Bill Cannon thinks this is a correct way to do business he needs to have his moral compass taken to the repair shop." Conversely, Attorney Bill Cannon is quoted as saying: "This is equally available to Habush if he weren't so cheap to bid on his own name." Though mildly... Parents Cannot Waive Children’s Right to Sue for Negligence

Parental Waivers Not Worth the Paper They Are Printed On? In what appears to be the first ruling of its kind in Canada, the British Columbia Supreme Court has ruled that parents cannot waive their children's rights to sue for negligence when the child is injured as a result of participating in recreational or sports activities. In Wong v. Lock's Martial Arts Centre Inc, Justice Willcock held that British Columbia's Infants Act: "Does not permit a parent or guardian to bind an infant to an... I have been asked to speak at the Atlantic Province's Trial Lawyers Association conference tomorrow about certification of class actions. Birmingham Personal Injury News: FDA Reluctant to Discipline Doctors Found Guilty of Criminal Activities

It's a sad commentary that some physicians are more concerned about personal gain than about people. As an Alabama personal injury lawyer, I've seen the victims of medical malpractice up close and I'm appalled by the seemingly lack of compassion on the part of many doctors whose actions result in the injury or death of a patient. Anyone who has suffered from medical mistakes, improper surgerical procedures, or other physician-related errors should contact an experienced personal injury attorney... Alabama Personal Injury News: 3.8 Million Toyota Vehicles Recalled for Safety-Related Problem

Some of the simplest automobile defects can potentially kill and injure innocent people. Recently, across Alabama and elsewhere, Toyota recalled nearly four million cars and trucks for a problem that may cause the gas pedal to stick. This could make the vehicle accelerate out of control, possibly injuring the driver and passengers, and potentially endangering pedestrians and occupants of other vehicles. Curiously, the problem has to do with the floor mat design in some of the company's... Posted on November 4, 2009 at 08:42 am

    FUTURE PAIN & SUFFERING

Read an interesting case today on the issue future damages. In Maddox v. Rozek, the First District Appellate Court of Illinois was faced with an issue involving future damages. Specifically, after a verdict for plaintiff in an auto case, the defense appealed, arguing that the jury should never have received an instruction on future pain and suffering because their was no expert[i.e. doctor]witness who testified that plaintiff would have problems in the future. After surveying the law, the Court... Posted on November 16, 2009 at 09:46 pm

Halloween Can Mean Injuries to Minors and Children

Many families are rightly concerned about the dangers to small children during the Halloween season. However, older children and teens also face several risks during this time of years: 1) Burn injuries. Children of all ages can burn themselves on candle decorations, dry ice used to decorate a punch bowl, jack o' lanterns, and other Halloween accessories. Thin, flammable costumes only add to the dangers. Even makeup and face painting can cause skin reactions and burns if the chemicals used are... Posted on October 29, 2009 at 07:09 am

New Study Finds Trucking Companies, Unsafe Trucks Causing Injuries and Deaths

America's highways are unsafe because trucking companies routinely violate safety standards, keeping unsafe trucks and drivers on the road. Heparin Overdose Responsible for Death of Infant

Heparin overdoses have caused the death of an infant and has injured at least 16 children at a hospital in Corpus Christi, Texas. The children were administered 1,000 times higher the prescribed amount of the blood thinning drug. The overdose has lead to the death of one of the infants, and leaves another in critical condition. Nurses at the hospital administered 10,000 units of heparin instead of the prescribed 10 units per child. The mistake wasn't caught until two days later. Hospital... As a Philadelphia accident and injury lawyer, I often receive questions about who may be at fault or sued in certain accidents. Put Family Loans in Writing; Have Others Collect for You

Sometimes clients tell me they've either loaned money to their children or their children have loaned money to them. As an attorney, I lean toward having these commitments reduced to writing so everyone is clear and there are no surprises. Of course, the decision to put the agreement in writing is ultimately left up to the clients, but there are several issues to consider with any family loan. What is Spinal Cord Injury?

Spinal Cord Injury (SCI) is damage to the spinal cord that results in a loss of function such as mobility or feeling. Frequent causes of damage are trauma (car accident, gunshot, falls, etc.) or disease (polio, spina bifida, Friedreich's Ataxia, etc.). The spinal cord does not have to be severed in order for a loss of functioning to occur. In fact, in most people with SCI, the spinal cord is intact, but the damage to it results in loss of functioning. SCI is very different from back injuries... Posted on June 25, 2007 at 11:54 am

'How long do I have to sue in Massachuetts for injuries from a car accident?'

Generally, you have three years from the date of the accident to bring a lawsuit in Massachusetts for injuries sustained in an auto accident. There are exceptions however, such as a two year statute of limitations for claims stemming from accidents involving MBTA vehicles. Also, if you live in Massachusetts and your auto accident was in a different state, then that state's laws apply. Not all states have a three year statute of limitations like Massachusetts does.
