Another Florida Court Agrees That AAA Declining Case Does Not Void Arbitration Agreement
Two of Florida intermediate appellate courts have now ruled that pre-dispute arbitration clauses which refers health care disputes to the American Arbitration Association (AAA) are nonetheless valid -- even though the AAA will decline the case -- because referral to the AAA is not typically an integral term. It was reported last week that there may be a error generated by the software family court uses to calculate child support payments. As a default (i.e. if there is no other agreement in place), NJ uses a formula known as the child support guidelines. The court uses software to to the calculations on each case where it is required. I love being a mentor-mediator. A mentor-mediator is a Virginia Supreme Court certified mediator that has mediated for at least 2 years & gone through the recertification process at least once. I found it rather surprising to learn that Belize -- a former British colony located in central America -- only recently had its first mediators trained (by professionals from Jamaica). Dealing with "Frivolous" Lawsuits
Congress is currently considering legislation that would reverse the Supreme Court's decisions in Iqbal and Twombley, discussed here previously. Hard Cases Create Hard Times for Arbitration.
Senator Al Franken succeeded in getting his first piece of legislation passed, an amendment to a defense appropriations bill that would prohibit defense contractors from requiring employees to submit to mandatory arbitration. The amendment was prompted by the case of Jamie Leigh Jones, who has been attempting to sue Haliburton and KBR over claims that she was raped and held against her will by co-workers. Mediators Puzzle Over Social Media
Social Media- you mean when reporters go for drinks? Honestly, who doesn't get a little befuddled understanding what social networking is and what it's good for. Facebook, Twitter and the array of social bookmarking sites (Digg, Stumbleupon, Kirsty, Fark) all essentially do the same thing. They connect people of like mind or interest. I am happy to report that the team from my alma mater, Pepperdine Law School, won the prestigious Willem C. Vis (East) International Commercial Arbitration Moot in Hong Kong.
